Terms and conditions for participating in all Pilatay physical programming.

1. In consideration of being granted to enter the site or participate virtually, and in consideration of being allowed to participate in the personal fitness training activities and programs both in-person and online of Pilatay LLC / Tracy Belcher / Eternal Sunshine Studio and to use its facilities, equipment and/or services, in addition to the payment of any fee or charge, I do hereby forever for myself, my successors, assigns, executors, administrators, and personal representatives, waive, remise, release and forever discharge Tracy Belcher, Pilatay LLC, Eternal Sunshine Studio LLC, 2343 CORAL WAY, LLC, Simbros LLC, and their employees, directors, managers, and their officers, agents, employees, executors, officers, consultants, and contractors and assigns, acting officially or otherwise, from any and all claims, liabilities for injuries, or damages, demands, actions or cause of action, on account of my death or on account of injury to my person or property,  including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf, arising out of or connected with my participation in any activities, programs or services of Tracy Belcher, or the use of any equipment at various sites, including home, provided by and/or recommended by Tracy Belcher, which may occur from any cause while I am on site. I accept full responsibility for my safety and agree to fully comply with all safety rules and regulations while on the site.

2. I have been informed of, understand and am aware that strength, flexibility and aerobic exercise, including the use of equipment, is a potentially hazardous activity. I also have been informed of, under- stand and am aware that fitness activities involve a risk of injury, including a remote risk of death or serious disability, and that I am voluntarily participating in these activities and using equipment and machinery with full knowledge, understanding and appreciation of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death.

3. I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation in these activities or use of equipment or machinery. I do hereby acknowledge that I have been informed of the need for a physician’s approval for my participation in the exercise activities, programs and use of exercise equipment. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and consultation with my physician as to physical activity, exercise and use of exercise equipment. I acknowledge that either I have had a physical examination and have been given my physician’s permission to participate or I have decided to participate in the exercise activities, programs and use of equipment without the approval of my physician and do hereby assume all responsibility for my participation in said activities, programs and use of equipment.

4. I understand that Tracy Belcher / Eternal Sunshine Studio LLC / Pilatay LLC providing and maintaining an exercise/fitness program for me does not constitute an acknowledgment, representation or indication of my physiological well-being or a medical opinion relating thereto.

5. I understand that Tracy Belcher / Eternal Sunshine Studio LLC / Pilatay LLC is not liable for attendees WIFI failure or technical issues. We are not responsible for incorrect emails upon sign up.

6. All content, filming or audio copies of this and any event presented in person or online are the sole property of Tracy Belcher / Eternal Sunshine Studio LLC / Pilatay LLC. 

7. Social Media Consent: For good and valuable consideration, for which receipt of which is hereby acknowledged I hereby consent and agree that Tracy Belcher / Eternal Sunshine Studio LLC / Pilatay LLC, (“Company”) and their agents, representatives, employees, interns and/or volunteers have the right to take photographs and/or video recordings of myself during my visit with Company or use any photo or video related to my experience with Company (collectively the “Images”).  Company may use these Images, in perpetuity, throughout the world, in any and all social media channels or Company’s website for the purposes of marketing and promoting Company.  I further consent that my name may be revealed by description text or commentary and Company may use approved opinions or testimonials.  I specifically consents to the editing or altering of my likeness in any of the Images and waive the right to inspect or approve the finished product.  I waive any rights, claims, interest, to the Images and additionally waive all rights to royalties, or any other compensation arising out of or related to, the use of the Images, my name or likeness.

I hereby hold harmless, release, and forever discharge the Company from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

In signing this consent, I acknowledge and represent that I have read and fully understand this consent before signing it, and are signing this consent on my own free act and deed. No oral representations, statements, or inducements, apart from the foregoing written statement, have been made. 

I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENT/GUARDIAN AS EVIDENCED BY THE SIGNATURE BELOW.
